3. PLATFORM DESCRIPTION
3.1 Nature of Services
Fixydo is a connection platform that facilitates introductions between Customers seeking services and Providers offering services. We are NOT:
- A service provider or contractor
- An employer of Providers
- A payment processor or escrow agent
- A guarantor of service quality or outcomes
3.2 Platform Limitations
We do not:
- Handle or process payments for services
- Guarantee the availability, quality, or safety of services
- Endorse any particular Provider
- Verify the accuracy of all Provider qualifications
- Control the actual performance of services
4. USER RESPONSIBILITIES
4.1 General Conduct
You agree not to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Post false, misleading, or deceptive content
- Transmit viruses or malicious code
- Interfere with the proper working of the Services
- Circumvent any security or access controls
4.2 Service Providers
As a Provider, you agree to:
- Provide accurate information about qualifications, experience, and licenses
- Only offer services you are legally qualified to perform
- Maintain appropriate insurance if required by law
- Not request advance payments or deposits
- Comply with all applicable laws and regulations
- Honor accepted bookings unless legally prevented
4.3 Customers
As a Customer, you agree to:
- Provide accurate service requirements
- Not make false or misleading requests
- Pay for services as agreed with Providers
- Provide accurate feedback based on actual experience
- Not engage in fraudulent chargebacks
5. SERVICE BOOKINGS AND PAYMENTS
5.1 Booking Process
- Customers request services through the Platform
- Providers may accept or decline requests
- Once accepted, a booking is confirmed
- All service details should be documented through Platform messaging
5.2 Payment Terms
CRITICAL: Fixydo does NOT handle service payments.
- All payments for services occur DIRECTLY between Customer and Provider
- We do not process, hold, or guarantee any payments
- Payment terms are negotiated between Users
- We recommend documenting payment agreements through Platform messages
5.3 Payment Disputes
Since we do not process payments:
- Payment disputes must be resolved directly between Users
- We may provide messaging tools for dispute resolution
- We are not responsible for unpaid services or payment disputes
- Users assume all risks associated with direct payments
6. CANCELLATIONS AND REFUNDS
6.1 Cancellation Policy
Our separate Cancellation Policy governs booking cancellations. By using our Services, you agree to:
- Comply with cancellation timeframes
- Accept penalties for late cancellations
- Understand Provider cancellation consequences
6.2 Refund Policy
Our separate Refund Policy governs financial recourse. Key points:
- Service payment refunds are between Customer and Provider
- Premium subscription refunds have specific conditions
- We do not guarantee or process service refunds
7. PREMIUM SUBSCRIPTIONS
7.1 Subscription Features
Providers may purchase Premium Subscriptions for:
- Enhanced profile visibility
- Verified status badge
- Priority in search results
- Additional promotional features
7.2 Subscription Terms
- Billed according to selected plan
- Auto-renewal unless cancelled
- Non-transferable between accounts
- Subject to our Refund Policy
7.3 Cancellation of Premium
- Providers may cancel Premium at any time
- No pro-rata refunds for early cancellation
- Premium features immediately disabled upon cancellation
8. INTELLECTUAL PROPERTY
8.1 Platform Content
All Platform content, including:
- Fixydo name, logo, and design elements
- Website design and layout
- Proprietary software and code
- Documentation and materials
are owned by Fixydo Services or our licensors and are protected by copyright, trademark, and other intellectual property laws.
8.2 User Content
You retain ownership of content you post (“User Content”), but grant us a worldwide, non-exclusive, royalty-free license to:
- Display your User Content on the Platform
- Use for Platform operation and improvement
- Promote the Platform (with attribution)
8.3 Restrictions
You may not:
- Copy, modify, or create derivative works
- Reverse engineer or decompile the Platform
- Use our trademarks without permission
- Remove copyright notices
9. PRIVACY AND DATA
9.1 Privacy Policy
Our Privacy Policy governs how we collect, use, and share your information. By using our Services, you consent to our data practices as described in the Privacy Policy.
9.2 Data Security
While we implement reasonable security measures:
- We cannot guarantee absolute security

We do NOT guarantee:
- The quality, safety, or legality of services
- The accuracy of Provider information
- That services will meet your requirements
- Continuous, uninterrupted, or secure access
- The actions or conduct of Users
11.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXYDO SERVICES SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
- PERSONAL INJURY OR PROPERTY DAMAGE
- ANY DAMAGES ARISING FROM USER INTERACTIONS
- ANY AMOUNT EXCEEDING $100 USD
11.4 User Responsibility
You are solely responsible for:
- Your interactions with other Users
- Verifying Provider qualifications
- Ensuring payment security
- Compliance with applicable laws
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Fixydo Services, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any rights of another
- Your interactions with other Users
- Any service you provide or receive
13. TERMINATION
13.1 By You
You may stop using our Services at any time. To delete your account, contact support@fixydo.com.
13.2 By Us
We may suspend or terminate your access if:
- You violate these Terms
- We suspect fraudulent activity
- Required by law
- You create risk or possible legal exposure
- You cease to meet eligibility requirements
13.3 Effect of Termination
Upon termination:
- Your right to use the Services ceases immediately
- You remain liable for obligations incurred before termination
- We may retain your information as described in our Privacy Policy
- Premium subscriptions are not refunded
14. DISPUTE RESOLUTION
14.1 Governing Law
These Terms shall be governed by the laws of the country where the User is located, without regard to its conflict of law provisions.

- Direct Negotiation: Parties must attempt to resolve disputes directly

For legal proceedings, the courts of the United Arab Emirates shall have jurisdiction, though Users may be subject to the laws of their own country.
14.4 Class Action Waiver
YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
15. MODIFICATIONS TO TERMS
15.1 Right to Modify
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email at least 30 days before they take effect.
15.2 Acceptance of Changes
Your continued use of the Services after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Services.

16. GENERAL PROVISIONS

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16.3 No Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
16.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
16.5 Force Majeure
We shall not be liable for any failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
16.6 Notices
All notices shall be in writing and deemed given when:

- Sent by confirmed email to support@fixydo.com
- Posted on our website
16.7 Relationship
Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between Users and Fixydo Services.
16.8 Third-Party Rights
These Terms do not confer any rights on any person or entity other than the parties to these Terms.

I HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE. I UNDERSTAND THAT:
- Fixydo is a connection platform only
- Payments are handled directly between Users
- I am responsible for my interactions with other Users
- I must comply with all applicable laws
